Punishment of the crime

1. Any person who intends to engage in development activities, such as changing the form and quality of land in violation of the National Land Planning and Utilization Act, shall obtain permission from the competent authority;

Nevertheless, from February 2016 to August 2016, the Defendant occupied or used public waters by drawing seawater from nearby beaches through the PVC material pipe (250m in diameter, 11m in length) to operate a new fish farming business without obtaining permission to occupy or use public waters from the public waters management authorities.

3. A person who intends to engage in fisheries cultivating marine animals or plants at land or plants artificially created on land or sea waters in violation of Acts and subordinate statutes shall obtain permission from the competent authority for each fishing vessel, fishing gear, or facility;

Nevertheless, from May 7, 2016 to August 2016, the Defendant engaged in inland sea-water cultivating fisheries by entering the land indicated in paragraph (1) in a manner of planting KRW 800,000 “new seedlings” without obtaining permission from the competent authorities.

4. No one shall illegally occupy or use agricultural production infrastructure without justifiable grounds;
