Punishment of the crime

No person shall commit an act of infringing on trademark rights and exclusive use rights, such as delivering, selling, forging, forging, or possessing, for the purpose of using, or making another person use, a trademark identical with or similar to another person's registered trademark on goods identical with or similar to the designated goods.

1. Defendant A

A. On September 2016, the Defendant sold 204 points from around 6,328,000 won, such as the clothes attached with a forged trademark to F, to F, the trademark rights of each of the above registered trademark holders, by selling 1,069 points totaling 1,069 points of clothing, 32,978,00,00 won, such as Paris Rots, and Accenture, to F, from February 2017, the Defendant sold 6,328,00 won from February 1, 2017.

B. On March 17, 2017, the Defendant purchased KRW 28,30,00 of clothing 28, such as “Tampers 8,” with a forged trademark attached from the above F, from March 17, 2017 to April 7, 2017, as indicated in the [Attachment List 1-2] from March 2017, including selling to customers at that time, the Defendant purchased KRW 264 points 5,71,00 of the clothing that forged the registration of another person’s trademark, such as “Tampts,” and “Tampers” from the above F, and sold it to unspecified customers, thereby infringing upon the trademark rights of each trademark holder.

2. Defendant B

A. On January 2, 2017, the Defendant purchased 40 clothing 1,395,000, including around 32,00,000, from among the fact that he/she had a forged trademark attached from the above F in the fluorial fluor of the new Seodaemun-gu Seoul, Jung-gu, Seoul, for sale to customers around that time, and from January 2, 2017 to April 13, 2017, as indicated in the attached Table 2-1 of the daily list of crimes, such as the above F’s “F fluorts”, “T fluor”, “S”, “S,” “S,” “Is,” “Is,” “Is,” “Is,” and “Canadian,” “Is,” respectively.
