Reasons
Punishment of the crime

However, at the time, the Defendants did not have any intent or ability to return the money received from the victims if they failed to perform the terms of the above agreement due to a difficult relationship with the victim, such as the Defendants’ repayment of personal obligations and use of living expenses, etc. for the purpose of living expenses. In the absence of any specific property at the time, the Defendants did not have any intent or ability to return the money received from the victim if they failed to perform the said agreement.
As a result, the Defendants conspired to deception the victim and received property from the victim.
On June 21, 2011, Defendant A received a summary order of KRW 1,500,000 as a fine for a violation of the Road Traffic Act (driving) from the Seoggu District Court’s Branch Branch on June 21, 2011, and issued a summary order of KRW 3 million as a fine for a violation of the Road Traffic Act (driving) and a fine for a violation of the Road Traffic Act (Driving without a license) from the same support on October 10, 2011.
