Reasons
Punishment of the crime
1. Permission to build a new plant of K forest on March 2013;
A. On March 2013, Defendant A received a request from the said M to “Nreal estate” in the “NE’s operation on the racing market,” stating, “I would like to obtain permission for new construction of a factory in K forest,” and “I would like to obtain permission as soon as possible on the face of KRW 50,000,000,000,000,000,000 won.”
Accordingly, the Defendant received 20 million won in cash from the above M, and three copies of the KRW 10 million in face value at the above place in the same month.
As a result, the defendant received money and valuables under the pretext of soliciting the cases handled by public officials.
B. Defendant B received a request from Defendant A to the relevant public officials to “whether he/she is entitled to obtain a new factory construction permit in K forest and field,” around the time and time of the entry in the preceding paragraph, the Defendant stated that “I will settle the case with KRW 30 million.”
Accordingly, the Defendant received from Defendant A one sheet of KRW 5 million per face value at a coffee shop in Dongcheon-dong, Dongcheon-dong, and one sheet of KRW 5 million per face value at the above A’s vehicle after approximately 15 days.
As a result, the defendant received money and valuables under the pretext of soliciting the cases handled by public officials.
2. Permission for new construction of an O forest warehouse on April 2014;
A. On April 9, 2014, Defendant A and Defendant C met Q, a real estate broker, at the real estate office in the real estate office operated by Defendant C on P on April 9, 2014. However, Defendant A also demanded the same purport as Defendant C to the effect that “The above Q carries out 12 public officials of all Ministries in relation to the construction of a new O forest warehouse.”
Then, the defendant C is the victim, who is the vice president of the SP Co., Ltd. located in Ulsan-gu R around 23:00 of the same day.
