All appeals by the defendant and the prosecutor are dismissed.

1. Summary of grounds for appeal;

A. The Defendant (misunderstanding of facts) did not commit an indecent act by force against the victims as stated in the facts charged.

B. The prosecutor (unfair sentencing)’s sentence of the lower court (one month of imprisonment with prison labor, two years of suspended sentence) is too unhutiled and unfair.

2. Determination

A. ‘라고 진술하였는데, 피고인은 범행 당일 주황색 니트와 청바지를 입고 있었던 점, ② 피해자 E의 진술 중 범행을 먼저 목격한 사람이 누구 인지와 관련하여 일부 불명확한 부분이 있으나, 범행을 인식하게 된 직후 뒤를 돌아봤을 때 주황색 니트를 입은 피고인이 피해자의 바로 뒤편에 있었다는 취지의 진술은 일관되어 피해자의 진술을 신빙할 수 있는 점, ③ 피해자 F는 수사기관에서 ’ 갑자기 뒤에서 저를 안아 양손으로 제 양쪽 가슴을 옷 위로 만져 깜짝 놀라 소리를 지르며 뒤를 돌아보니 주황색 니트를 입은 남자가 저를 만졌다‘ 고 진술하였고, 원심 법정에서도 ’ 당시 주황색 니트를 입은 팔이 올라오는 것을 봤고, 바로 뒤를 돌아봤을 때 자신과 밀착해 있던 사람은 피고인 뿐이었다‘ 는 취지로 진술하여 그 진술이 명확하고...
