Reasons
Punishment of the crime
1. The Defendant in violation of the Act on Special Cases Concerning the Settlement of Traffic Accidents is a person driving a B observer car.
On January 28, 2016, the Defendant proceeded along the two-lanes in front of the shooting distance of the Gumpon post office in the Gumyeong-dong 45-5, Sim-si, Sim-si, Sim-si, Do, 43-5, along the two-lanes from the Gu to the additional distance.
At the time, it is night, and at the same time, D-hurbed car driven by the victim C(25 years) was a stop in the signal atmosphere, so there was a duty of care for the driver of the vehicle to see the front door well and operate the brake accurately and safely.
In doing so, the Defendant neglected to do so, while under the influence of alcohol 0.1% in blood, and did not look at the front, and proceeded as it is. In so doing, the Defendant received the panion of the instant observer car from the front offender of the said observer car.
As a result, the Defendant suffered from the above occupational negligence, injury to the victim C, such as salt, tension, etc. in front of the border line (in tension) requiring approximately two weeks of treatment, injury to the victim E (25 years of age) who was on a flurged vehicle, such as crums and tensions in need of approximately two weeks of treatment, injury to the victim F (V, 26 years of age), such as salt, tension, etc. in front of the border line in need of approximately two weeks of treatment, and injury to the victim G (32 years of age) who was on the flurg, requiring approximately three weeks of treatment.
2. On January 28, 2016, the Defendant driven the said options under the influence of alcohol with a 0.1% alcohol level at approximately 1 km from the front of the land club located in the Gu-si Pyeong-si, Gu-si to the place indicated in paragraph (1) of the same day from January 28, 2016.
