1. The plaintiff is based on the insurance contract stated in the attached Table No. 1 with respect to the accident described in paragraph 2 of the attached Table.
Reasons
1. Basic facts
A. The Plaintiff is an insurance company running the insurance business, and the content thereof 1) The Plaintiff is an insurance contract indicated in Paragraph (1) of the attached Table No. 1 with Nonparty B, the Defendant’s relatives (hereinafter “instant insurance”).
(2) The terms and conditions of the instant insurance include the following provisions.
[The Company shall pay the insurance proceeds to the insured (the subject of insurance) under Section 17 (Types and Grounds for Payment of Insurance Money) of Section 3 (Kinds and Grounds for Payment of Insurance Money) if any of the following events occurs to the insured (the subject of insurance). The insured shall pay the insurance proceeds agreed upon to the beneficiary (the beneficiary of the insurance money).
(3) When each disability payment rate prescribed in attached Table 1 (Disability Classification) is less than 80% in the insurance period, the amount calculated by multiplying the payment rate prescribed in attached Table 1 (Disability Classification) by the insurance amount shall be paid to beneficiaries (persons who receive insurance proceeds) as the insurance proceeds for general follow-up disability.
Article 18 (Detailed Provisions concerning Payment of Insurance Money) (2) Notwithstanding subparagraphs 2 and 3 of Article 17 (Types of and Grounds for Payment of Insurance Money), Article 17 (Types of and Grounds for Payment) (2) subparagraphs 2 and 3 of Article 17 (Types of and Grounds for Payment of Insurance Money) shall apply to any disability which appears temporarily after the completion of treatment but if the period is at least five years, the rate of payment of the relevant disability shall be 20%.
Ⅲ. Attached Table 1 【Disability 1】
1. 1) "Disability" means a state of damage to a permanent mental or physical body remaining after recovery of an injury or disease, except that the state of the disease or injury, complication, and symptoms temporarily appearing in the course of being treated as a result of the disease or injury, shall not be included in the disability. 2) "permanent" is, in principle, in a state in which there is no possibility of recovery in the future.
