1. The Defendant (Counterclaim Plaintiff) paid KRW 21,019,518 to the Plaintiff (Counterclaim Defendant) and the Plaintiff’s counterclaim from July 4, 2013 to July 14, 2015.

1. Facts of recognition;

A. On June 12, 2012, the Defendant, under the trade name of “C”, stated D (actual operator as her husband) that operates a construction enterprise, as “C”, D stipulated D as “F and one parcel of land owned by the Defendant,” but in fact, D was a contract for constructing a new house on three lots of land of “F, H, and I”.

On the other hand, three bonds (Adong, B Dong, and C Dong) are newly constructed on a detached house, and the construction cost is KRW 350 million (excluding value-added tax) and the construction period is from June 14, 2012 to November 30 of the same year, and the defendant transferred the down payment amount of KRW 50 million to D on the above contract date.

B. However, around June 24, 2012, the above E and the Plaintiff’s representative director G sought to transfer and take over the above construction work as the Plaintiff. The Defendant accepted it and prepared a construction contract agreement with the Plaintiff, which states that the construction cost of KRW 350 million is the same as that of the above D, and the contract date is the same as that of the above D, and the contract date is the same as that of the above D (hereinafter “instant construction contract”).

C. The Plaintiff completed the instant construction and obtained approval for use on July 3, 2013, following the same year.

7.9. The registration of initial ownership has been completed in the name of the defendant.

The appraiser 1,507,00 won of A's stairs expansion construction cost is calculated as KRW 916,254 won in the initial appraisal report, and 590,746 won was increased in the plaintiff's response to the plaintiff's application for supplementation.
