A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant committed the crime against the victim B at the “D” office located in Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-gun, on March 201, 201, stated that “In-Gu E operates a computer poptopy program office in F in Ansan-si, Gyeonggi-do. E sells 60 computer popto B with 10,000 won for each computer poptopy program. The daily profit per 8,000 won is 8,000,000 won. However, even if 30 minutes can be purchased with money, the president purchases 30 parts of G because he could not purchase money due to shortage of money. The purchased computer equipment is operated at the workplace operated by E, and the profits every month would be distributed to the same amount as invested by E received three times.”

However, the defendant did not have any intention or ability to pay profits even if he received money from the victim because he did not purchase a computer device from E.

Accordingly, the Defendant, as such, by deceiving the victim, received total of KRW 3 million from the victim on March 11, 201, KRW 17 million on March 15, 201, KRW 4 million on three occasions, including KRW 4 million on March 31, 201, and KRW 24 million on March 31, 201.

2. Around April 15, 2011, the Defendant of the crime against the victim H expressed that “The Defendant would purchase 15,000 won per 1.3 million won per 1,30,000 won, and pay the profits.”

However, the defendant did not have any intention or ability to pay the profit by receiving money from the victim because he did not purchase a computer device from E.

Accordingly, the Defendant, as such, deceiving the victim and deceiving him/her from the victim on April 20, 201, KRW 2 million around April 21, 201, KRW 2 million around April 21, 201, and KRW 1 million.
