1. The Defendant’s KRW 19,652,507 as well as 5% per annum from October 28, 2016 to November 17, 2016 to the Plaintiff.

From the end of 2014, the Plaintiff requested the Defendant to return the lease deposit, and the Plaintiff decided to request the brokerage office for the lease of the instant real estate.

On December 25, 2014, the Defendant reported only a portion of the rent that it received from the Plaintiff, and requested the Plaintiff to prepare a lease contract on December 25, 2014, and entered into a lease contract (Evidence A5) with the lease deposit of KRW 100,000 won, monthly rent of KRW 29,000 (excluding value-added tax), and the lease term of KRW 25,000 from January 25, 2015 to December 25, 2015. However, on January 25, 2015, the Defendant again entered into a lease contract (Evidence A2) around January 25, 2015 with the wind that the Defendant affixes his/her seal on the Plaintiff’s name. The lease term was entered from January 25, 2015 to December 25, 2015.

On June 2015, the Plaintiff: (a) requested the Defendant to return the lease deposit, and (b) requested the Defendant to return the lease deposit by arranging the instant real estate by October 5, 2015.

In this regard, the defendant confirmed how to adjust the lease contract with the plaintiff by making contact with the management office and installing banner.

However, the plaintiff contact the defendant on August 2015, and the defendant still remains the lease term, so there is no reason to refund the lease deposit and the plaintiff rather is the lease term.
