피고인은 2012. 12. 15. 18:50경 혈중알코올농도 0.199%의 술에 취한 상태로 C 액티언 승용차를 운전하여 광주 북구 효령동에 있는 마을버스정류장 앞 편도 2차로 중 2차로를 담양 쪽에서 영락공원 삼거리 쪽으로 시속 약 30km 로 진행하였는데, 전방을 잘 살피고 조향, 제동장치를 정확하게 조작하여 사고를 미연에 방지하여야 할 업무상 주의의무를 게을리한 채 진행한 과실로 도로 밖 우측에 주차된 D 소유의 E 승용차의 왼쪽 뒷부분을 피고인 승용차 앞부분으로 충격한 다음 진행 방향 1차로로 튕기면서 그곳을 지나가던 피해자 F(여, 52세) 운전의 G 승용차의 우측 앞부분을 피고인 승용차 앞부분으로 충격하고, 이어서 피해자 H(34세) 운전 I 승용차 좌측 앞부분을 피고인 승용차의 좌측 앞부분으로 충격하였다.
