1. The plaintiff's claim is dismissed.

1. Basic facts

A. The defendant is a branch of the Korean Automobile Workers' Union under the Seoul Bus Workers' Union.

The plaintiff is a member of the above trade union and belongs to the defendant.

B. On January 15, 2012, the Defendant held an election for branch representatives on February 10, 2015 (hereinafter “instant election”) on the ground that the term of office of the branch representatives elected by the election held on January 15, 2012 ends on February 28, 2015.

The public notice of the instant election was written as follows: “The term of office of the branch representatives elected pursuant to the amendment of the Regulations was until February 29, 2016.”

C. The Plaintiff was a candidate for the instant election, but failed.

[Rules of this case] Article 46 (Composition) (2) The branch office shall have a district election commission for the fairness of the election of the branch office.

Article 68 (Election of Branch Representatives and Term of Office) (1) An election of branch representatives shall be governed by the regulations on the election management separately determined.

(2) The terms of office for representatives of a branch office shall be three years based on the year of the branch office or accounting, and they may be reappointed, and the terms of office for members of the branch office assigned shall be the remaining period of all representatives.

Article 10 (Right of Election and Right of Election) (2) A person shall be eligible for election and right of election only to members who have joined and worked (maintenance, other operators) or on board two days prior to the public announcement of election.

(4) An election for a branch or an executive officer shall be elected only to the members of a cooperative who have paid union expenses normally for one year from the date of public announcement of the election.
