A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
1. On April 12, 2017, the Defendant: (a) around Apr. 12, 2017, the Defendant: (b) around Apr. 12, 2017, under D’D operated by the Victim C (B) on Apr. 12, 2017, the Defendant: (c) “A building located in the name of the Republic of Korea and located in the Republic of Korea is transferred to the victim KRW 70 million; (d) the inside price is KRW 20 million; and (e) the Defendant loaned the building to the victim only KRW 50 million; and (e) the Defendant would pay KRW 120 million on Apr. 20, 2017.
The phrase “ makes a false statement.”
However, at the time, the Defendant was thought to use the money from the damaged party to pay the above debt with the amount to be paid every day when the debt and bond of the financial institution were 340 million won or more, and the interest to be paid every month was 900,000 won or more, and there was no intention or ability to pay the loan by selling the name of the building in the other party after transferring it.
The Defendant, by deceiving the victim as such, was transferred KRW 50 million to the credit union account (Account Number E) in the name of the Defendant on the same day from the victim.
2. On April 21, 2017, the Defendant, as described in the foregoing paragraph 1, by deceiving the victim, took advantage of the victim, and then returned KRW 30 million out of the total amount to the victim on April 19, 2017, thereby obtaining the victim’s trust. The same applies to the victim again on April 21, 2017, compared with the market price that the victim gave the victim KRW 70,000 to the other party’s building.
The loan of KRW 30 million is about KRW 30 million and KRW 30 million until July 31, 2017.
