A is the president of the "G Gameland" on the second floor of the 2nd floor of the F building in Gyeyang-gu, Yangyang-gu, and the defendant B is an employee of the above game room, who performs the carbr business, clean-up business, and customer care.

No game products provider shall allow any person to gamble or perform other speculative acts using his/her game products, or leave him/her to do so.

1. 피고인 A 피고인은 2014. 6. 초순경부터 2014. 7. 30.경까지 사이에 위 게임장에서, ‘뉴 미스터손’ 게임기 70대, 게임기 자동진행장치(일명 ‘똑딱이’) 70대 등을 설치해 놓고 그곳을 찾아온 불특정 손님들로부터 10,000원을 받으면 500원 짜리 동전 20개를 교환해주어 손님들이 500원 짜리 동전을 위 게임기에 투입하여 게임을 할 수 있게 하였다.

한편, 손님들이 500원 짜리 동전 20개를 게임기의 동전 투입구에 넣으면 게임화면 좌측 하단 'Credit'창에 10,000점이 생성되고 게임기의 'Start'버튼을 누르면 게임이 실행되어 1게임당 100점씩 감소하는데, 게임이 시작되면 5장의 카드가 펼쳐지며 손님들은 원하는 카드를 그대로 보유하고 나머지 카드를 교체하여 최종적으로 가지고 있는 5장의 카드가 구성하는 무늬와 숫자에 따라 점수를 획득하고, 이와 같은 진행방식을 통해 획득한 점수는 게임기 좌측 하단 'Bank'창에 표시되는바, 손님들은 위와 같이 게임장에 비치되어 있는 ‘똑딱이’를 이용하여 여러 대의 게임기를 동시에 진행하여 게임 결과에 따라 짧은 시간에 많은 점수를 얻거나 잃게 된다.
