Punishment of the crime

Where a land use activities not directly related to agricultural production or farmland improvement in an agricultural promotion zone is prohibited, and the use of a building belonging to an industrial facility group outside an urban area is changed to a use corresponding to a business facility group, the use of the building shall be reported to the competent administrative agency.

1. The Defendant violated the Farmland Act, on May 1, 2013, changed the use of the first, second, and third floors among the fourth floors constructed on the ground of 1,653m2 in Kimpo-si, Kimpo-si, an Agricultural Promotion Zone, and operated a golf range from June 13, 2013, with the trade name “F”. On August 2013, the Defendant changed the use of the fourth floors among the above fourth floors into a golf range with screen screen. On September 16, 2013, the Defendant operated a golf range from around September 16, 2013 to the above trade name.

Accordingly, the defendant committed a land use act not directly related to agricultural production or the improvement of farmland in the agricultural promotion area.

2. Violation of the Building Act;

A. On May 13, 2013, the Defendant, without filing a report on the alteration of the use of a building with the Kimpo-si Mayor, operated a golf practice range with the trade name “F” from June 13, 2013 to “F”, when the first, second and third floors (total 901.35m2) from among the fourth floors of the use of the mountainous distribution facilities belonging to the facility group, such as the industry, etc. constructed on the ground of 1,653m2 on the land of the E site in the Hapo-si Kimpo-si, Kimpo-si, Kimpo-si.

Accordingly, the defendant changed the use of the above warehouse building without reporting the change of the use of the building to the Kimpo City Mayor.

B. The Defendant, without filing a report on the change of the use of a building with the Kimpo-si Mayor, changed the use of the remaining four stories (324.9 square meters) from among the buildings of mountainous district distribution facilities belonging to the facility group, such as industry, etc. around August 2013 to a screen golf course falling under the facility group for business use in a warehouse, and thereafter changed the use of the remaining four stories (324.9 square meters) from the point of September 1
