1. Defendant A’s imprisonment for ten months, Defendant B’s fine of KRW 10 million, and Defendant C’s fine of KRW 10 million.

Punishment of the crime

Defendant

A is the actual management owner of Defendant B Co., Ltd. (hereinafter “B”), and is the representative director and the management owner of Defendant C Co., Ltd. (hereinafter “C”).

1. Defendant A

(a) A petroleum retailer of petroleum products, general agencies, etc. that obstruct the distribution of petroleum shall receive petroleum products from petroleum refining business entities, petroleum exporters, or general agencies and sell them to other general agencies, gas stations, general retail shops, or consumers, and shall not supply or receive petroleum products or alternative fuels in violation of the scope or business methods of each sales business;

Nevertheless, Defendant A purchased tax-free oil tanks (MGO) and heavy oil oil tanks (B-A) from a vessel whose name is unknown at the five wharfs located in the Dong-dong area of Busan, for each petroleum sales business, in violation of the scope or business method of the oil sales business, and stored them in the oil tank of the E-ship. On January 5, 2016, Defendant A supplied petroleum products to the 100 dums (MGO) via (20,000 dums) 180 dums (B-A) 180 dums (26,00 lums) among oil supply (20,00 lums) 180 dums (36,00 lums) 180 dums (20,000 lums) from time to July 31, 2017, Defendant B supplied petroleum products to the 21964,605 1605 dums and 27 165 ms (165.20.4,5).7

As a result, Defendant A committed each act detrimental to the sound distribution order of petroleum in relation to Defendant B and C.

(b) Any person who intends to engage in a project related to the transportation of non-registered ports and harbors (ship oil supply business) shall be the head of the regional marine fisheries office as prescribed by the Ordinance of the Ministry of Oceans and Fisheries for each type of harbor business.
