The grounds of appeal are examined.

On the grounds indicated in its reasoning, the lower court rejected the allegation in the grounds of appeal disputing misunderstanding of facts and misapprehension of legal principles as to the facts charged of the insult of this case, and upheld the lower judgment.

The allegation in the grounds of appeal disputing the judgment of the court below is merely an error of the fact-finding by the fact-finding court in accordance with the principle of free evaluation of evidence, and even if examining the grounds alleged in the grounds of appeal in light of the evidence duly admitted, it did not err by exceeding the bounds of the principle of free evaluation of evidence, or by exceeding

In addition, the grounds alleged in the grounds of appeal are neither asserted by the court of final appeal nor by the grounds under Article 383 of the Criminal Procedure Act, nor legitimate grounds of final appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
