A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On September 7, 2017, the Defendant concluded a false statement to the effect that “The Defendant would receive a loan of KRW 20,000,000,000 from other financial institutions to perform funeral services, and, if so, would receive a loan from other financial institutions within one week, receive a refund in a way that he/she will repay the loan or make a repayment in a way that he/she will change the debtor’s name.”

However, at the time of fact, the Defendant borrowed money from the victim to repay his/her debt to another person, and it was difficult for the Defendant to refund the money or change the name of the debtor even if he/she borrowed money from the victim with respect to the debt such as E-financial institution and mobile phone loan, personal bond, etc., and there was no intention or ability to repay the money borrowed from the victim due to economic difficulties.

Nevertheless, on September 7, 2017, the Defendant, by deceiving the victim, had the victim borrow a total of KRW 20 million, including KRW 10 million from F, KRW 10 million from E, and KRW 10 million from E, and received delivery of KRW 20 million from G bank account in the name of the Defendant (H) following the following day.

Accordingly, the defendant was given property by deceiving the victim.

2. The Defendant in violation of the Guarantee of Automobile Accident Compensation Act is a holder of Igland knife.

No motor vehicle owner shall operate a motor vehicle that has not been covered by mandatory insurance.

Nevertheless, the defendant on June 1, 2017, around 08:13 and the same month.

6. At around 15:11 above, the above-mentioned vehicle was operated without purchasing each mandatory insurance policy on the front roads of the Annexed kindergarten in the JJ of the Chungcheongnam-gu, Chungcheongnamnam-si.
