1. It is based on No. 887, 2013, No. 887, No. 2013, Dec. 13, 2013, between the Defendant and C.

1. Basic facts

A. The Plaintiff, around April 2004, operated the Fsanbu and the Busan Si as a partnership with Nonparty C, etc., lent KRW 100 million to C, and repaid KRW 209,241,540 of the above hospital’s debt to C on behalf of Nonparty C.

B. Thereafter, the Plaintiff filed a lawsuit against C with the Daegu District Court 2013Gahap5408. On December 6, 2013, the court rendered a judgment that “C shall pay the Plaintiff 162,098,311 and 35,000,000 won with the interest rate of 20% per annum from June 8, 2013 to the date of full payment, 67,698,31 won with the interest rate of 10% per annum from June 8, 2013 to the date of full payment, and 5% per annum from March 16, 2010 to June 7, 2013 to the date of full payment.”

C. From January 1, 2006 to December 13, 2013, the Defendant remitted a total of KRW 110,983,000 to C as the wife type C, and received a total of KRW 48,954,000 from C.

On December 13, 2013, the Defendant and C drafted a notarial deed of a monetary loan agreement (No. 887, 2013, No. 2013, 2013, stating that “The Defendant, on October 28, 2013, lent KRW 150,000 to C with interest rate of KRW 12% per annum and due date on November 28, 2013, and that “If C fails to perform the said monetary obligation, he/she has no objection even if he/she is immediately subject to compulsory execution.”

(hereinafter the above debt repayment contract is "the instant debt repayment contract," and the above notarial deed is "the notarial deed of this case"). E.

Based on the above authentic copy of a notarial deed, the Defendant received each of the orders of seizure and collection (hereinafter “each of the orders of collection in this case”) as to the claim for the payment of payment for credit card to the National Health Insurance Corporation under the Daegu District Court Branch Branch 2013TT9627 on December 26, 2013, with regard to the claim for payment for payment for credit card refund to the National Health Insurance Corporation under the Daegu District Court Branch 2013TT967 on January 6, 2014, and each of the above orders was finalized around that time, and March 26, 2014.
