The plaintiff's claim is dismissed.

Reasons
1. Details of the disposition;
A. On March 11, 2019, the Plaintiff filed an application with the Defendant for a building report and permission for development activities to newly build a Class II neighborhood living facilities (office) with the area of 749 square meters in the area of a site (hereinafter “instant land”), 1,356 square meters in the area applied for permission for development activities (749 square meters in a site area, 749 square meters in an access road, and 607 square meters in an urban planning road), and the total floor area of 72 square meters in the area of a building.

On July 10, 2019, the Defendant notified the Plaintiff on July 10, 2019 that the instant report would be rejected due to the following reasons.
(1) According to Article 56 (Standards for Permission for Development Acts) [Attachment 1-2] subparag. 1 (Standards for Permission for Development Acts) and Article 20 (Standards for Permission for Development Acts) of the Enforcement Decree of the National Land Planning and Utilization Act, the standards for permission for development acts shall be calculated for the entire area subject to the permission, and the average slope level of the area subject to the permission is less than 17 degrees. Construction of roads on a site for a gold conference urban/Gun planning facility (road) and Article 56 (Permission for Development Acts) subparag. 6 (Infrastructure), 7 (Definition), 10 (Urban/Gun Planning Facility), and 11 (Standards for Permission for Development Acts) of the Enforcement Decree of the National Land Planning and Utilization Act provides that the standards for permission for development acts shall be calculated for the entire area subject to the permission, and the average slope level of the area subject to the permission for development activities shall be less than 17 degrees. However, the applicant shall be prepared to supplement the land subject to permission for development activities, including the average slope of the site subject to the permission for development activities within C.
