A defendant shall be punished by imprisonment for one year.

Punishment of the crime

On November 2014, the Defendant: (a) received a request from C to sell 6,805 square meters of Pyeongtaek-si E, which is a type D owner; and (b) received a request from the purchaser to the effect that the purchaser would inform the purchaser of the terms of sale and purchase agreement; and (c) sought the purchaser of the said forest through F; (d) even though C was delegated only for consultation on the terms of sale and purchase agreement, the Defendant, beyond the scope of the delegation, was willing to sell the said forest by putting the said forest under the delegation of all authority on the part of D with respect to the sale and purchase of the said forest; and (e) had the said F enter into a sales contract on behalf of the Defendant.

1. Around January 14, 2015, the Defendant altered private documents made F enter F in the “scope of delegation” column stating “F” and “F” as “F” and “D terms and conditions of the sale and purchase of land located in Pyeongtaek-si, Gyeonggi-do” column in the D’s power of delegation stating that “D, the owner of land located in Pyeongtaek-si, Gyeonggi-do, shall delegate consultation on the terms and conditions of the sale and purchase of the said land to B” without the consent of C and D” without the consent of C and D.

Accordingly, the Defendant modified the power of attorney, which is a private document in the name of D (hereinafter “the power of attorney of this case”) for the purpose of uttering.

2. On January 15, 2015, the Defendant: (a) had F enter into a sales contract with JJ on forest land at the I real estate office located in Pyeongtaek-si H on January 15, 2015; (b) had F present the power of delegation altered as stated in paragraph (1) to K staff of the said J, which was unaware of the fact that it was altered.

3. The Defendant is delegated by D and C only for consultation on the terms and conditions of the above forest land sales contract.
