A defendant shall be punished by imprisonment for not less than three months.
Reasons
Punishment of the crime
On September 25, 2009, the Defendant was sentenced to one year of imprisonment for fraud, etc. at the Chuncheon District Court, and was released on August 13, 201, in the execution of the sentence, on January 14, 2011, at the Gangnam Prison, and the parole period has expired on January 14, 201. On March 31, 2016, the Defendant was sentenced to five years of imprisonment for a crime of fraud, etc. in the Chuncheon District Court's Gangnam Branch branch branch.
6.3. The judgment became final and conclusive.
1. On October 26, 2012, the Defendant: (a) was granted a loan of KRW 22,00,000 from the victim’s two mountain Capitals Co., Ltd. on the condition that it would change from 36 months; and (b) was granted a mortgage on the vehicle to provide C dumpsp in the name of Defendant’s wife F, which he/she actually owns, as security, to provide the above victim with C dump trucks in his/her name.
Nevertheless, the Defendant did not pay the principal and interest at all from seven occasions, and did not reside at the registered domicile on January 2015, and rejected the victim’s demand for return of the said vehicle by means of avoiding contact with the victim and making it impossible to identify the location of the vehicle, thereby hindering the victim’s exercise of rights by concealing the vehicle that became the object of the mortgage.
2. On November 22, 2012, the Defendant: (a) obtained a loan of KRW 24 million from the same victim at the same place as the foregoing paragraph (1) on condition that 36 months change; (b) and (c) sought a mortgage on the vehicle from the above victim in order to provide the G dumpp in the name of the Defendant’s birth H, which he/she actually owns, as security.
Nevertheless, the Defendant did not pay the principal and interest at all from six occasions, and did not reside at the registered domicile on January 2015, and refused to demand the return of the victim to the said vehicle by avoiding contact with the victim and making it impossible to identify the location of the vehicle, thereby concealing the vehicle that became the object of the mortgage by the victim.
