A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 폭력행위등처벌에관한법률위반(집단흉기등상해) 피고인은 2013. 7. 18. 15:25경 경북 칠곡군 C에 있는 D 식당에서 아무런 이유 없이 그곳에서 식사 중이던 피해자 E(50세)에게 다가가 피해자가 먹고 있던 밥그릇 뺏어 집어던진 후 "사내새끼가 밥을 똑바로 처먹어라“라고 욕을 하고, 피고인이 차고 있던 가죽 허리띠를 풀어 한손에 쥔 채 피해자에게 휘두름으로써 위험한 물건인 금속 재질의 허리띠 바클 부분(가로 7cm x 세로 3.5cm x 높이 1cm)으로 피해자의 얼굴, 목, 어깨 등을 4회 내려치고, 다시 주먹으로 피해자의 얼굴을 수회 때려 피해자에게 약 5주간의 치료가 필요한 폐쇄성안와골절 등의 상해를 가하였다.

2. 폭력행위등처벌에관한법률위반(집단흉기등폭행) 피고인은 계속하여, 제1항 기재 일시, 장소에서 E의 부인인 피해자 F(여, 53세)이 피고인을 만류하자 피해자에게 "니는 뭐냐. 니도 한 번 디져볼래. 내가 너거집 찾아가서 풍지박살 내버린다”라고 말하고, 한손으로 제1항 기재 허리띠를 쥔 채 다른 한손으로 위험한 물건인 소주병을 들어 보이며 마치 피해자를 때릴 듯 위협한 다음, 피해자가 겁이 나서 뒤로 물러서자 피해자를 향해 위 소주병을 집어던졌다.

In this respect, the defendant carried dangerous objects and assaulted the victim.
