In light of the records, the court below is just in maintaining the judgment of the court of first instance that acquitted the defendant on the ground that all of the facts charged in this case did not prove the facts charged, and contrary to the allegations in the grounds of appeal, there is no error of law such as misunderstanding of facts beyond the bounds of the principle of free evaluation of evidence or misunderstanding of legal principles as to the criminal intent in fraud.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
