Defendant
A shall be punished by a fine for negligence of KRW 3,000,000, and by a fine of KRW 1,000,000.
The above fine is imposed against the Defendants.
Reasons
Punishment of the crime
D From March 3, 2015 to August 20, 2015, the person who was registered as the representative director of the E; Defendant B was registered as the representative director of the E from August 20, 2015 to October 12, 2015; Defendant A used as the representative director of the E E from August 20, 2015 to February 20, 2015; and Defendant A entered into an aggregate sales contract with the victim F around December 27, 2013; the person who entered into a delegation contract with the victim to produce sand from the G dredging site to sell sand; and H is the aggregate extraction business entity; and H is the aggregate extraction business entity.
Defendants, D, and H had the mind to interfere with the victim’s sand removal work by asserting that the aggregate sales contract concluded on December 27, 2013 between E and E is null and void.
1. Defendant B and D co-principaled with D, in collusion with D on August 26, 2015, Defendant B, from around 07:00 to around 09:14, obstructed the victim’s removal of sand by force, by setting up a scke at the entrance of the mooring unit at the G dredging site located in G G G G G G in the Gyeong-gun of Seongbuk-gun, Gyeongbuk-gun, thereby preventing the victim from leading up the quantity of sand taken out.
2. Defendant A
A. On September 21, 2015, from around 07:00 to around 16:00, Defendant A set up “J” low-speed typ vehicle at G dredging site in G G G G G G G G G G G G G G G G G G G G in the same field so that the victim may not take up sand quantity so that the victim may interfere with the victim’s removal of sand by force.
B. From October 5, 2015 to 17:00 on October 5, 2015, Defendant A placed “K” vehicle in G dredging site in G G G G G G G G G G G G G G G G G G G G G G G G in G G G G G G G G G G G G G in the same site and prevented the victim from extending the amount of sand taken out normally, thereby hindering the victim’s sand removal work.
C. Defendant A, from October 22, 2015 to October 17:00, 2015, is on the mooring part of the G dredging site at G dredging site at G G G G G G G G G G G G in the G G G-gun.
