A defendant shall be punished by imprisonment for not less than eight months.

An application for compensation by an applicant for compensation shall be dismissed.

Punishment of the crime

The Defendant is a person who runs a construction business with the name of F and a trade name of “G” when it is impossible to obtain a loan from a financial right because the credit rating is merely 10 grade.

From August 2010, the Defendant constructed a building of 24,00,000 from the Nam-gu Incheon Metropolitan Government H with a total of 36,00 (hereinafter “H lending”). At the time of the purchase of the above H site, the Defendant received a loan of 1,290,000 won as security at the time of the purchase of the said H site and carried out the construction of H lending by borrowing from the land owners.

After completion of H lending on June 15, 201, the Defendant borrowed a total of 3.9 billion H lending from the financial right as collateral and repaid land security loans, construction costs, loan loans, etc., but still remains unpaid construction costs, loan loans, etc.

Therefore, as long as the above lending is not sold in lots, it is not possible to fully repay the loan of 3.9 billion won, the unpaid construction cost, the loan of H lending and the land that already reached the credit limit.

On July 201, 201, the Defendant borrowed KRW 100,000 from I and J respectively for the payment of the construction cost to H lending. On July 20, 201, the Defendant delegated the right to set the lease of KRW 15,00,00 to J as security for KRW 200,000,000, and the J set the lease of lease of KRW 20,000 as security for KRW 401 and 402 respectively.

On July 1, 2011, the Defendant: (a) immediately paying the down payment of KRW 10,000,000 to the victim E with respect to “Yecheon-gu L and M land (hereinafter “N land”); (b) succeeds to the existing loan of KRW 4,80,000,000; and (c) paid KRW 1,40,000,000 out of the remainder of KRW 3,60,000,000,000 to July 22, 2011; and (d) fails to pay KRW 120,000,000,000 out of the remainder of KRW 22,00,000,000 by means of sale or sale until October 30, 2011.
