피고인은 2020. 6. 1. 00:20경 강원 춘천시 남산면 강촌로 122 ‘구곡교’ 앞 도로에서 술에 취한 상태로 B K5 승용차를 운전하던 중 가드레일을 들이받는 사고를 야기하였고, 피고인에게서 술 냄새가 나고 발음이 부정확하며 얼굴에 홍조를 띄는 등 피고인이 술에 취한 상태에서 운전하였다고 인정할 만한 상당한 이유가 있어 춘천경찰서 C파출소 소속 경위 D, 경위 E으로부터 음주측정기에 입김을 불어 넣는 방법으로 음주측정에 응할 것을 요구받자, 음주측정기에 입김을 불어넣는 시늉만 하면서 ‘음주측정에 응하고 있는데 왜 측정거부인 것이냐’라고 말하는 등의 방법으로 음주측정을 회피하여 정당한 사유 없이 경찰공무원의 음주측정요구에 응하지 아니 하였다.
