피고인은 2014. 11. 23. 06:30경 서울 은평구 B에 있는 C지구대 안에서 폭행 혐의로 조사를 받던 중 “내가 뭘 잘못 했느냐, 합의를 보려고 하는데 왜 잡고 있느냐, 건수 올리려고 사건 처리하냐”고 말하여 경찰관인 피해자 D가 피고인에게 조용히 해 줄 것으로 요구하자 이에 화가 나 같은 지구대 소속 다른 경찰관들 및 위 폭행 사건 관계인들이 지켜보는 가운데 피해자에게 “미친새끼 꼴갑떤다, 경찰새끼들 좆같은 새끼 병신자식들”이라고 말하여 공연히 피해자를 모욕하였다.
