Reasons
Punishment of the crime
On March 29, 2017, the Defendant was sentenced to 10 months of imprisonment and 2 years of suspended execution for violating the Special Act on the Prevention of Insurance Fraud at the Seoul Western District Court on March 29, 2017. The judgment became final and conclusive on April 6, 2017.
No person, other than the Seoul Olympic Games National Sports Promotion Foundation or an entrusted business entity, shall gambling by taking advantage of an act of providing property or property benefits to persons who win the results of sports promotion or others similar thereto, which have occurred.
Nevertheless, at around 17:55 on September 10, 2012, the Defendant connected to “C”, which is a similar gambling site to the sports promotion voting right operated by his/her name-free person using smartphones, at the Defendant’s residential place located in Overcheon-si B, and remitted 1870,000 won to the same company’s account for filling money for gambling in the above site, which is used at the above site, and upon filling the corresponding game money, he/she predicted the outcome of the sports games in Korea and abroad, and she saws game money by predicting the result of the sports games in Korea and abroad, and receives money in accordance with the fixed rate of distribution, if he/she fails to do so, and thereafter gambling by means of losing money, from September 30, 2012, the Defendant collected money in total by 111,710,000 won, as shown in the attached list of crimes.
