A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant, due to a mental disability (Grade III), was under the age of 10 and lacks the mental capacity to discern things or make decisions due to the shock adjustment disorder. On March 24, 2017, around 06:56, the Defendant committed an indecent act by force on the part of the victim E (V) who was released from subway to board a subway on the adjacent part of the subway in Busan Suwon-gu, and on March 24, 2017, reported the victim E (V, 22 years old) who was released from the subway in order to board the subway on the same part, and committed an indecent act by force against the victim by force.

그런데 피고인이 빤히 바라보는 그 표정으로 자신의 오른쪽 정강이 중간 부분을 아래에서 위로 훑듯이 쓱 만지고 지나갔다.
