A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a person who is engaged in the business of driving Cone Star Co., Ltd.

On August 19, 2013, at around 10:35, the Defendant driven the said passenger vehicle while under the influence of alcohol of 0.114% with a blood alcohol concentration of 0.14%, and led to a three-lane road in front of 1168, Nowon-gu, Seoul Special Metropolitan City of Gyeonggi-si along one lane from the center park towards the storm terminal.

Since there is a lot of traffic of vehicles, in such a case, there was a duty of care to operate the brakes by properly operating the brakes with a thorough care for those engaged in driving of vehicles.

그럼에도 불구하고 피고인은 위와 같이 술에 취하여 정상적으로 걷지 못하고 조는 등 정상적인 운전이 곤란한 상태에서 전방 주시를 태만히 한 업무상 과실로 같은 차로에 앞서 신호 대기 중이던 피해자 D(51세)이 운전하는 E 카렌스 승용차의 뒤 범퍼 오른쪽 부분을 피고인 승합차의 왼쪽 앞 범퍼 부분으로 들이받았고, 그 층격으로 위 카렌스 승용차가 앞으로 튕겨져 나가면서 신호 대기 중이던 피해자 F(여, 38세)이 운전하는 G 렉스턴 승용차 뒤 범퍼 부분을 위 카렌스 승용차의 앞 범퍼 부분으로 들이받게 하였다.

As a result, the Defendant, while driving a motor vehicle under the influence of alcohol which makes it difficult to drive the motor vehicle normally, suffered injury to the victim D, such as salt, scam, etc. in light of the influence of alcohol for about three weeks, injury to the victim F in light of the trend, tension, etc. requiring approximately two weeks of medical treatment, and injury to the victim H (V) who was on the said scamnife in light of the influence of alcohol for about ten days.
