Reasons
Punishment of the crime
[Status Relationship and Conduct of Public Opinion poll] Defendant A is the 17, 18, and 19 National Assembly members (O). Defendant B is the assistant officer of Defendant A; Defendant C is the representative of “P”, the public opinion poll company; Defendant D is the secretary general of the office of A National Assembly members, Defendant E, F, and G members of the O City Council.
In the PO of the 20th National Assembly member election implemented on April 13, 2016, and QU election districts (Joint Gus) were ① R, ② S, ③ National Assembly members of the 19th National Assembly, ④ Busan East High School Teachers, ⑤ Total of five people, including U, etc., completed preliminary candidate registration under V political parties.
In addition, V political parties announced the proposal for the 20th presidential election system to select candidates for the National Assembly members in each constituency by the method of competition (70% of general voters, 30% of party members) on January 11, 2016.
On the other hand, through Defendant B, Defendant A requested Defendant C to conduct a public opinion poll to verify the level of support for the O region in preparation for the intra-party competition, and Defendant C conducted a public opinion poll including the responsible party members at the time of V political partyO twice as follows.
1) On January 16, 2016, from January 17, 2016 to January 17, 2016 (10:0 to 21:50), the size of samples of “1,500 sample” was 1,50 for both days, and a public opinion poll was conducted on the following: (a) pro rata DD survey based on gender distinction, age classification, and proportional allocation of regional population for all areas at O; and (b) whether or not a candidate A and counterpart candidate S and U are political parties’ support.
2) On February 13, 2016, from February 14, 2016 to February 14, 2016 (10:0 to 21:50), the size of samples of “1,500 sample” was 1,50 for both days, and a public opinion poll was conducted on the degree of support for A and other candidates, S, and U, as well as on the degree of support for political parties and support for political parties by means of gender distinction, age classification, and proportional allocation of regional population.
