A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a person who has served as the chief secretary in the previous C Mine Name Market and is a member of the D Party who has no specific occupation at present.

On December 2, 2012, the Defendant: (a) knew of the fact that the victim E (here, 58 years of age) who was aware of while working as the chief secretary of the Mine Market, would have to retire from office when the regime change; (b) knew of the fact that the victim E, who worked as a special official in his office at the time of the change of the regime, would have been able to find ways to continue to work even after the change of the regime, and (c) approached the relationship between the persons related to the passport room and the government's senior senior high-rises and tried to help them find employment.

1. Around December 2012, the Defendant made a false statement to the victim with the purport that “F will continue to work in the Cheongdaedae because it is widely known that, in the office of the local constituency of the I member of the NA located on the fourth floor of the H branch of the National Bank H branch located in G in G, the Defendant would be able to say, “In the Republic of Korea, there is a friendly relationship with the J members of the D Party who is the actual owner of the current regime, and the name cannot be carried out daily, but the Defendant is aware of a large number of senior public officials.”

However, in fact, the defendant did not have any relationship with J Council members or the government senior citizens, and the defendant did not have any intention or ability to work F in Cheongdae.

Around January 5, 2013, the Defendant, by deceiving the victim as above, received a total of KRW 20 million, including KRW 100,000 won cashier’s checks and KRW 8 million in cash in the same coffee shop, as teaching expenses, from the victim, around January 5, 2013, at the coffee shop called “L” located in K in Yangcheon-gu Seoul Metropolitan Government, and received KRW 20,000,000 in cash in the same coffee shop around January 8, 2013.

2. Around March 27, 2013, the Defendant attempted to commit fraud made a false statement to the victim with the purport that “A Council member sent a F’s resume to the chief of the M president’s office because he/she made his/her speech and sent the F’s resume. This is the last time, which is 30 million won, will be employed clearly.”

However, the defendant requested employment through J Council members or submitted a resume to the presidential secretary office.
