1. All of the plaintiffs' claims are dismissed.

2. The costs of lawsuit are assessed against the plaintiffs.

1. Basic facts

A. The Defendant is a company that produces and sells sports clothes and sports supplies.

The Defendant and companies operating superstores, such as department stores, supplied goods manufactured by the Defendant to superstores, sold them by the said companies, and paid the remaining sales proceeds after deducting a certain amount of fees from the sales proceeds to the Defendant, and the manpower to conduct sales business within superstores entered into a special contract for purchase of department stores with the content that the Defendant would dispatch.

B. Accordingly, the Defendant and the Plaintiffs entered into a TPM contract (hereinafter “instant contract”) with the content that the Plaintiffs would sell the Defendant’s goods at the store in a superstore and pay a certain percentage of commission fees for sales performance from the Defendant.

The term of contract and the store of the plaintiffs shall be as follows:

C. The main contents of the instant contract are as follows.

(A) The Plaintiff and the Defendant have prepared multiple contracts, and the following details are based on the latest contract: “TPPM” under the contract shall be deemed to be “Plaintiffs” and “E” shall be replaced by “Defendants”). Article 4 [Rights and Duties]

1. The plaintiffs must calculate that the defendant's goods provided to the plaintiffs are sold in the defendant's name at the defendant's workplace.

In addition, the Plaintiffs are responsible for all management of the Defendant’s goods and places of business provided by the Defendant, and the Plaintiffs should sell only the goods and products provided by the Defendant.

7. The Plaintiffs, as consignment service providers, shall operate and manage the department stores (where they are not the department stores, buildings in which the business places are located) in which their business places are located.
