Reasons
Punishment of the crime
The defendant is the director general of the editing bureau B.
1. No one who is prohibited from distributing newspapers, magazines, etc. other than normal methods, shall distribute newspapers, communications, magazines, which carried articles related to an election, by any means other than normal methods, except as provided for in the Public Official Election Act;
Nevertheless, in order to assist in the election of candidates who belong to the E-party to which the above election is scheduled to be held on the date, the defendant did not have any content about other candidates, and did not want to distribute it to a large number of apartment mail located in the south F where there is no timely distribution of B, which is only an article about the core pledge of the E candidate, in connection with the D election to be held on the date.
On April 9, 2020, at around 01:30 on April 9, 2020, the Defendant moved 374 copies of the newspaper on which the core public supplies of candidates E are published, along with the e-mail photo of the above E on April 9, 2020, to the vehicle on April 9, 2020, and around 01:30, around 01:30 on April 9, 2020, 32 copies of the apartment mail in the previous H apartment mail, around 01:37 on the same day and around 01:59 on the apartment mail, around 02:30 on the same day, around 20:40 on the same day; around 02:40 on the same day; on the same day, around 02:40 on the same day, around 02:47 on the same day; on the same day, around 15, 2015 on the method other than the method of ordinary publication;
2. No one shall make contributions to a candidate or political party to which he/she belongs in connection with an election, such as prohibition and restriction on contributions;
Nevertheless, with respect to D elections scheduled to be held on the date of C, the Defendant: (a) stated B 374 copies, which are the only articles of the E candidate’s core pledge, and the amount of KRW 4,000,00,000, among electors in the place specified in paragraph (1) from April 9, 2020 to April 01:5, 200; and (b) stated B 374 copies, which are the only articles of the E candidate’s core pledge.
