The judgment of the court below is reversed.
A defendant shall be punished by imprisonment for six months.
However, for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Summary of Grounds for Appeal
A. In regard to the crime of injuring a victim on August 27, 2011 (Article 1 of the crime of injuring a victim on August 27, 201), the lower court found the Defendant guilty of this part of the charges, which erred by misapprehending the facts and adversely affecting the conclusion of the judgment. 2) In regard to the crime of injuring a victim on September 3, 2011 (Article 2 of the crime of injuring a victim on September 3, 2011 (Article 2 of the original judgment), although the Defendant spawn the head on drinking at a level of giving attention to the victim who is a seafarer on September 3, 2011, the lower court erred by misapprehending the facts and adversely affecting the conclusion of the judgment. However, the lower court found the Defendant guilty of this part of the charges.
B. Unless otherwise, the lower court’s sentencing (six months of imprisonment) is too unreasonable.
Judgment
A. The following circumstances, which can be acknowledged by the court below based on the evidence duly adopted and examined by the court below as to the assertion of mistake of facts, i.e., victim D, at the investigative agency and the court of original instance, (i) at around 23:00 on August 27, 201, when the victim was living in the bed room, and the defendant was unable to have the victim work immediately, and (ii) at the bed of the victim’s face and shot, etc. on September 3, 201, stated consistently to the effect that “the defendant was using the victim on the floor and taken two to three occasions on September 3, 201,” and (iii) at the court of original instance, E was also at the scene, and witnessed the situation where the defendant was scambling the victim’s face and scambling the victim on deck.
In full view of the fact that “the victim’s statement is consistent with the victim’s statement, ③ the description of the victim’s injury diagnosis report and the photographs on the upper part of the victim’s statement are consistent with the victim’s statement.
