The plaintiff's claim is dismissed.

Litigation costs shall be borne by the plaintiff.

1. Basic facts

A. On June 17, 2020, the Defendant and D (the Plaintiff’s words “instant building”) entered into a sales contract with the purchase price of KRW 375 million (the lease deposit of KRW 37.5 million, the current lease deposit of KRW 23 million, the buyer’s succession of the remainder of KRW 314.5 million, and the remainder payment date of the remainder payment (hereinafter “the first sales contract”) on September 17, 2020. The Defendant received KRW 37.5 million on the date of the contract.

B. On August 27, 2020, at the Plaintiff’s request, a sales contract was concluded by converting the buyer from D to the Plaintiff under the same terms and conditions as the buyer, and the down payment was replaced by the down payment paid at the time of the first contract.

The remainder payment date was postponed on September 18, 2020 as of September 17, 2020.

E. On September 18, 2020, the Plaintiff had not been deemed to have been at the time of the contract prior to the payment of the remaining amount to the Defendant.
