1. The plaintiffs' claims against the defendants are all dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Basic facts
A. On July 2, 2010, D Co., Ltd. completed the registration of ownership transfer in its name with respect to the real estate listed in the separate sheet (hereinafter “each of the instant real estate”) on July 2, 2010, and completed the registration of ownership transfer with respect to the Mugunghwa Trust Co., Ltd. on the same day on June 28, 2010.
B. On March 25, 2011, the foregoing Rose of Sharon Trust issued a public auction notification with respect to each of the instant real estate, and the Plaintiffs received a successful bid for each of the said real estate in the public auction procedure and completed the registration of ownership transfer with respect to each of the instant real estate on April 20, 201, and completed the registration of ownership transfer with respect to each of the instant real estate on the same day to one another (hereinafter “one another trust”) as a trust.
C. 1) The Plaintiffs filed a lawsuit against the Defendants, who possessed each of the instant real estate in subrogation of one of the instant trusts, claiming for the surrender of the building name as the District Court Decision 2011Da36285 decided July 25, 2012. The said court accepted the Plaintiffs’ claim on July 25, 2012, and accepted “The Defendant delivery of each of the instant real estate to one of the instant trusts (hereinafter “the judgment on the declaration of provisional execution”).
(2) The Defendants appealed against the judgment of the provisional execution sentence of this case, and filed an application for the suspension of compulsory execution based on the judgment of the provisional execution sentence of this case (hereinafter “application for the suspension of compulsory execution of this case”), and the said court accepted the application for the suspension of compulsory execution on August 31, 2012 and decided to suspend compulsory execution.
3. On May 16, 2013, the above appellate court rendered a judgment dismissing all appeals by the Defendants. The above judgment became final and conclusive around that time, and the Defendants’ respective real estate in this case on June 7, 2013.
