Reasons
Punishment of the crime
1. The Minister of Food and Drug Safety may, if necessary for national health, determine and publicly announce the standards for labels of foods or food additives for sale, or for labels of apparatus, containers and packages, the standards for which are determined, and no foods, etc., the standards for labels of which are determined shall be sold, imported, displayed or transported for sale, or used for business, unless they are indicated in compliance
Nevertheless, around September 15, 2013, the Defendant: (a) around September 15, 2013, at the “D” store located in Seodaemun-gu Seoul Metropolitan Government and the Do floor, “E” was a product that requires a product name, food type, manufacturing source location, content, names of raw materials, ingredients and content, nutritional ingredients, and other precautions for consumer safety to be indicated on the product packaging or container; (b) however, without indicating such matters, the Defendant sold 4,800 stuffs to Defendant B without indicating such matters.

Nevertheless, from September 20, 2013 to November 7, 2013, the Defendant “E” in Seodaemun-gu Seoul Metropolitan Government and the Health Functional Foods Sales Business Group D located on the branch floor from September 20, 2013 should indicate the product name, food type, manufacturing source location, content quantity, raw material name, ingredients and content, nutritional ingredients, and other precautions for consumer safety on the product packaging or containers.
