A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

No person shall receive subsidies by making a false application or by other unlawful means.

In implementing the “B” which provides subsidies, such as personnel expenses, to enable companies to create new jobs for professionals, etc., if a company continues to employ employees who had been employed before the commencement date of the support, the following viewing limits the payment of subsidies, such as personnel expenses, by participating in the relevant business as a person who has been employed.

Nevertheless, on April 8, 2019, the Defendant prepared a “B application” at the “D’ office of the Defendant’s Operation of the Defendant, and submitted it to the Cheongsan-si Office, and on April 26, 2019, the said union prepared a “B agreement” by mutual agreement with the Cheongsan-si Office to receive a subsidy for newly employing one professional manpower in the metal sector. On February 11, 2019, the Defendant prepared a “B agreement” as if he/she was newly employed on June 1, 2019, and submitted a written contract as if he/she was newly employed on June 1, 2019.

Accordingly, on August 8, 2019, the Defendant received KRW 20 million in total as shown in the list of crimes in attached Form 22,00,000 from the following day, from around April 29, 2020, as the Agricultural Cooperative Account (F) in the name of the said Association, from the following:

As a result, the Defendant received subsidies by false application or other unlawful means.
