Defendant

A shall be punished by imprisonment for four years, and imprisonment for two years and six months, respectively.

The defendants are every 80 hours.

Punishment of the crime

[2018 Gohap166] Defendant A and Defendant B are in line with each other who had the same high school.

1. Defendant A

A. A quasi-indecent act by compulsion on May 24, 2018, around 09:43, the Defendant drinking alcohol, such as the victim F (the victim F), at the D E convenience store located in Jeju Island, and drinking the victim’s chest by drinking the victim’s body, and drinking the victim’s breast at the G hotel H at the Jeju city.

Accordingly, the defendant committed indecent acts against the victim by taking advantage of the victim's mental or physical state of difficulty.

B. At around 12:14 on May 24, 2018, the Defendant: (a) committed an indecent act against the victim F; (b) went out of the said G hotel; (c) was aware of the general hotel; and (d) asked B with the inside of the ship; and (c) there was a defect in B in the same G hotel in the case of “a woman who saw H is locked; (d) was aware of the width; (e) was left at the seat of the entrance; and (e) caused B to have the victim feel to have sexual intercourse.”

Therefore, at around 12:26 of the same day, the Defendant exceeded, and had the victim engage in sexual intercourse with, the victim who was locked by drinking in the above G hotel H on the same day.

Accordingly, the defendant instigated B to have sexual intercourse with the victim by taking advantage of the victim's mental or physical disability or non-performance condition.

C. From around 14:00 on August 1, 2013 to 03:00 on the following day, the Defendant: (a) opened a entrance with no corrective device in front of the house of the Victim K; (b) opened the door; and (c) opened up the door; and (d) cut off with two swine fests with the cash amounting to KRW 1.40,000,000 in cash owned by the Victim K.

2. Defendant B: (a) around 12:26 on May 24, 2018, Defendant B heading 1-B of the above G hotel H.

Pursuant to the teachers of A such as Paragraph A, the victim who received the key of the above H heading from the hotel knife and met with the H heading and knife the victim.
