1. The plaintiff A:

A. Defendant C is entitled to KRW 94,440,00 within the scope of the property inherited from the network E, as well as KRW 94,440,00.

1. Basic facts

A. Plaintiff A is the birth of the deceased E (the deceased on May 11, 2017, hereinafter “the deceased”). Defendant C is the deceased’s spouse, and Defendant D is the deceased’s children.

B. From January 6, 2003 to May 18, 2009, the sum of KRW 297,400,000 was deposited or transferred from the Plaintiff’s name or the Plaintiff’s account to the Deceased’s account as indicated below.

Amounting to KRW 50,00,000 on January 6, 2003: KRW 297,400,000 on November 28, 2005; KRW 47,400,000 on August 3, 2006; KRW 400,000 on September 6, 2006; and KRW 40,000 on January 30, 2007; KRW 70,00,000 on May 18, 2009; and KRW 297,40,000,000 on May 18, 2009.

C. From February 23, 2009 to October 21, 2010, the sum of KRW 124,800,000 was transferred or deposited from the Plaintiff’s name or Plaintiff B’s account to the Deceased’s account as indicated in the following table.

On February 23, 2009, KRW 124,800,000 on March 2, 2009, KRW 20,800 on April 2, 2009, KRW 30,000 on April 12, 2009, KRW 000 on July 15, 2009, KRW 20,000 on October 26, 2009, KRW 20,000 on October 21, 2010, KRW 124,80,000 on a total of KRW 10,000 on October 21, 2010.

D. As the deceased died, the Defendants inherited the deceased’s property. On August 9, 2017, the Defendant C reported the inheritance limited approval, and was adjudicated to accept it by the Suwon District Court Decision 2017Radan515.

Defendant D reported the inheritance limited approval on August 8, 2017, and was tried to accept it by Suwon District Court Decision 2017 Madan2074.

[Ground of recognition] A without dispute, Gap evidence Nos. 1, 3, 5, 7, Eul evidence Nos. 1, and Eul evidence Nos. 1 and 1 (including each number), the court's order to submit each financial transaction information to F Co., Ltd. as of May 8, 2018, and the purport of the whole pleadings, as a result of the order to submit each financial transaction information as of August 21, 2018,

A. From January 6, 2003 to May 18, 2009, Plaintiff A lent a total of KRW 297,400,000 to the Deceased. The Deceased repaid the principal of KRW 140,000 on September 7, 2006, KRW 10,000 on November 9, 2006, KRW 10,000,000 on July 12, 2011, KRW 30,000,000 on August 23, 2013, and KRW 50,000 on October 20, 2016, KRW 140,000 on a total of KRW 140,000.
