1. The Defendant (Counterclaim Plaintiff) paid KRW 5,361,886 to the Plaintiff (Counterclaim Defendant) and its related amount from November 20, 2013 to August 18, 2015.
Reasons
1. Basic facts
A. The Plaintiff is a company that manufactures and sells machinery parts, and the Defendant is a company that manufactures metal assembly materials.
B. On October 26, 2012, the Plaintiff was awarded a contract on December 26, 2012, 2012, for the production of TS Daegu 7,000 tons of PRES BENDD Hadrodide 2 trop (hereinafter “instant trop”) from the non-party corporation, Inc., Ltd. (hereinafter “Sene”) with the production price of KRW 58,000,000,000, and the payment period as of December 26, 2012.
C. In order to produce the instant mar, the Plaintiff purchased ten materials (names: SDR61) from the Non-Party Sejong Special DD61 on a total of 24,485,00 won, and completed a smuggling, which requires KRW 16,036,170 as working expenses, and requested the Defendant to process heat first for two materials first on or around January 2013. After the Defendant supplied the said two materials to the Plaintiff, the Plaintiff again requested the Defendant to process heat (hereinafter “the first heat treatment”), and then supplied them to the Plaintiff, and then the Defendant again requested the Defendant to process heat (hereinafter “the second heat treatment”). D. The Plaintiff supplied all the above materials to the Plaintiff.
원고가 피고로부터 납품받은 이 사건 자재 중 1차 열처리한 2개의 자재는 큰 변형이 없었지만, 2차 열처리한 8개의 자재는 0.5mm 내지 3mm 가량 휨이 발생하였고, 전체적인 길이도 짧아져 있었으며, 그로 인하여 제작도면에 표시된 나사구멍간 간격도 줄어드는 등의 변형(이하 ‘이 사건 하자’라 한다)이 발생하여 원고는 이 사건 몰드 전부를 세아스틸에 계약기간 내에 납품하지 못하게 되었고, 납기지연일을 줄이기 위하여 2013. 4.경 소외 주식회사 윈윈기계(이하 ‘윈윈기계’라 한다)에 세아스틸로부터 제작을 의뢰받은 동일한 몰드의 제작을 의뢰하였는데, 원고가 윈윈기계에 그 제작대금으로...
