A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On September 14, 2009, the Defendant issued a summary order of KRW 1 million for a violation of the Road Traffic Act at the Busan District Court on September 14, 2009; the summary order of KRW 2 million for the same crime at the same court on February 16, 2010; the summary order of KRW 5 million for the same crime at the same court on August 31, 2012; and the summary order of KRW 7 million for the same crime on August 1, 2014 at the Busan District Court’s Dong Branch Branch.

On July 27, 2015, at around 23:40, the Defendant driven CK7 car without obtaining a driver’s license from a section of approximately 1.2 km of blood alcohol concentration from a section of approximately 0.081% of blood alcohol concentration to the front of the Busan National Agricultural Cooperative to the return of the same Busan National Cemetery, from the East-gu, Busan National University-dong.

As a result, the Defendant was under the influence of alcohol not less than twice and was punished, and once again under the influence of alcohol.
