Reasons
Punishment of the crime
Around January 28, 2015, the Defendant posted a letter of “to sell Vene-Choe mobile phones” on the Internet-based Korean car page using a mobile phone from the French land in Gyeonggi-do.
However, the defendant did not have any intention or ability to sell mobile phones.
Nevertheless, the defendant received 40,000 won from the victim C to the account under the name of the defendant in the name of the victim.
From that time to July 12, 2015, the Defendant received a total of KRW 590,000 from the victims seven times in the same manner as indicated in the list of crimes in the attached Form.
Accordingly, the defendant deceivings victims to take the property by deceiving them.
On June 17, 2015, the Defendant, “2016 Highest 177, the Defendant, at the “E entertainment room” located in Pyeongtaek-si D around 21:51 on June 17, 2015, made use of the gaps in which the victim F was neglected due to the negligence of care in his game, and carried out 3 smartphones equivalent to KRW 800,000 in the market value of Samsung Gggal, which was owned by the victim on the game machine.
Accordingly, the defendant stolen the victim's property.
“The Defendant,” posted by G on the bulletin board of “Mphone 40,000 won for cultural merchandise coupons 97,00,000,” in the 201st place, posted a false statement to the effect that “Aphone 40,000 won for cultural merchandise coupons 97,00,000,” and then, on the same day, posted a false statement to the effect that “Aphone 32,00 is to sell Aphone 40 mobile phone” on the said bulletin board, and made a false statement to the victim H who visited him.
However, in fact, the defendant had the intent to acquire cultural merchandise coupons from G by allowing the victim to pay the price, but did not have the victim's intent or ability to sell mobile phone.
The defendant deceivings the victim as above and let the victim do so on the same day under the name of the above G as the mobile phone price.
