1. The plaintiff's appeal is dismissed.
2. The costs of appeal shall be borne by the Plaintiff.
The purport of the claim and appeal is the purport of the appeal.
Reasons
1. Basic facts
A. 1) The Plaintiff, C, and D (hereinafter “Plaintiff, etc.”)
(1) On September 1, 2009, the Defendant will operate a single-class store (interest car) as a Dong business, and on September 1, 2009, the whole of the first floor of the Seoul Mapo-gu Ground Buildings (hereinafter referred to as the “instant store”).
(3) A lease agreement stating that the lease deposit is KRW 30 million, monthly rent of KRW 1.6 million, and the lease term is one year from September 1, 2009 to September 1, 2010 (hereinafter “instant lease agreement”).
(2) Around that time, the Plaintiff et al. started a single-place business with the trade name “F” after paying the above lease deposit to the Defendant.
B. Around September 1, 2010, the Plaintiff, etc. concluded a lease agreement with the Defendant to increase the monthly rent of KRW 2 million and extend the term of the lease to August 31, 201. After that, until September 1, 2012, the Plaintiff, etc. concluded a lease agreement to extend the term of the lease by up to August 31, 201. From September 1, 2012, the Plaintiff, etc. concluded a lease agreement to extend the term of the contract by one-year unit, while increasing the monthly rent as shown in the attached Table around the expiration date
C.1) Thereafter, D withdrawn from the above partnership relationship. On September 1, 2013, C and the Plaintiff concluded a lease agreement with the Defendant on the lease deposit of KRW 30 million, monthly rent of KRW 2.9 million, and the lease period from September 1, 2013 to August 31, 2014. 2) After that, upon C’s withdrawal from the above partnership relationship on June 18, 2014, the Plaintiff entered into a lease agreement with the Defendant on June 19, 2014, under the name of the Plaintiff’s spouse, the Plaintiff changed the deposit amount of the instant store from the Defendant to KRW 30 million, monthly rent of KRW 290,000 (payment of KRW 30,000,000, monthly rent of KRW 300,000, monthly rent of KRW 290,000, monthly rent of KRW 1301, July 14, 2014.
