1. With respect to the real estate listed in paragraph 1 of the attached list to the plaintiff A, the defendant E shall be senior to the District Court of Jung-gu.
Reasons
1. Basic facts
A. On March 27, 2006, G: (a) on March 27, 2006, with respect to H 89,199 square meters of land (hereinafter “real estate prior to subdivision”), G completed the registration of creation of a mortgage with the maximum debt amount of KRW 720,00,000,000, the maximum debt amount of KRW 420,000,000 with the Bank on April 7, 2009; and (b) on August 24, 2011, I and J (hereinafter “I, etc.”) each of the maximum debt amount of KRW 1,30,000,000 with respect to H 89,19 square meters of land (hereinafter “real estate prior to subdivision”); (c) completed the registration of creation of a mortgage with the maximum debt amount of KRW 15836,00,0000,0000 with respect to Defendant E’s High Government Branch Branch, and (d) Nonparty 10,001,5000.
(B) Each of the above collateral security rights in the name of the Defendants (hereinafter “instant respective collateral security”).
Plaintiff
A on October 19, 2012, G and real estate before subdivision, KRW 24,450 square meters (hereinafter “real estate subject to sale”) were the sales price of KRW 1,96,920,00,000, down payment of KRW 200,000,000, the remainder of KRW 1,796,920,000 on the date of the contract, and the remainder of KRW 1,796,920,00,000 on the date of the contract, and the remainder of KRW 1,796,920,000 on the date of payment by January 29, 2013, G entered into a sales contract (hereinafter “the sales contract of this case”) with the sale price of real estate subject to sale and purchase as one parcel of land.
C. On September 13, 2013, at the request of G’s agent, the Defendants prepared a written confirmation of the following contents (hereinafter “instant confirmation”) and delivered it to K with a certificate of the personal seal impression. K photographs and transmitted it to Plaintiff’s agent L with a photograph.
The plaintiff A confirmed that he remitted 300,000,000 won out of the instant purchase price to G, and G remitted 260,000 won to the defendants, and K delivered the instant confirmation to L around the same day.
