1. The Defendant’s fraud is a person who operates the “E” as a lubrication Do and retail company located in B at the time of lubing.
On March 2, 2007, the Defendant concluded an oil retail business agreement with the victim-specific energy tech Co., Ltd. and received lux oil at an average of 20-25 drums monthly supply. On May 2, 2015, the Defendant concluded a false statement to the effect that “The Defendant would make payments under the same conditions as “the Defendant would make payments to the employees in charge of the victim- Gwangju branch office’s name in the above “E” office on the basis of the credit supply of at least 50 drums per month.”
However, in fact, E’s financial standing was difficult at the time, and in order to prevent the default of bills, around KRW 200 million was borrowed from F from May 2015 to July 2015, the amount of outstanding bonds and lubrication supply to E business partners should be used in the repayment of the above borrowed amount. On January 14, 2008, in order to secure the payment of lubrication to the victim, the maximum amount of claims 79,200,000 won was set up in G G G building owned by the Defendant, but it was difficult to cover the payment even if the maximum amount of claims 12,00,000,000 won was voluntarily auctioned in consideration of the fact that the highest amount of claims lubrication was 12,00,000 won, and there was no intention or ability to pay the payment from the victim’s company, such as there was no property.
Around May 6, 2015, the Defendant: (a) by deceiving the victim; (b) received from the victim, from the victim; (c) the amount equivalent to KRW 1,543,850 at the market price of Kix GL-4 80W/90 and five items (50) from the above E office; and (d) received, from the victim, the Defendant received, from the victim, the lux GL-4 80W/90, the amount of KRW 1,543,850 from July 30, 2015, the Defendant supplied the lux product totaling KRW 58,886,24
