A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

1. Fraud;

A. On December 27, 2011, the Defendant entered into a false statement with the victim C, stating that “The Defendant shall pay the full-time loan of the beauty room, which he/she worked together with the denied during the current divorce conciliation period, to the victim,” and that “If he/she lends KRW 2.7 million to the victim, he/she shall be paid the full-time loan of KRW 3 million by receiving the full-time contract amount around eight months.”

However, since the defendant did not have any specific income at the time, he thought that he borrowed money from the victim and used it for the cost of living, and even if he borrowed such money from the victim, he did not have the intention or ability to pay it properly.

As above, the Defendant, by deceiving the victim, received KRW 2.7 million from the victim to the Agricultural Cooperative Account under the name of the Defendant on the same day, and received KRW 18,630,000 in total from around that day to November 6, 2012, and acquired KRW 13 times in the same manner as the list of crimes (1) in attached Form 1, and acquired KRW 18,630,00 in total.

B. On February 13, 2012, the Defendant acquired credit cards by fraud, the following false statements were made: “A person who borrowed a credit card, if there exists a credit card, would use the card only once to put it in the vehicle.”

However, even if the Defendant borrowed a card from the victim, he did not intend to use the card only one time for the payment of the oil price. From the beginning, he was thought to use the card for the personal purpose other than the oil price. Since there was no particular income at the time, there was no intention or ability to pay the card properly even if he used the card for the personal purpose.

The Defendant, as above, deceiving the victim, received a modern card under the victim’s name from the victim’s position, and around February 18, 2012, 30.
