피고인은 2014. 4. 15. 02:40경 김해시 C에 있는 ‘D카페’ 앞 도로에서 술이 만취한 상태로 누워 있다가, 주민들의 신고로 현장에 출동한 김해중부경찰서 E지구대 소속 피해자 경위 F, 순경 G가 인적사항을 확인하면서 귀가시키려고 하자, “내가 간다. 이 새끼야. 짭새야.”라고 소리치면서 G의 멱살을 잡고 손바닥으로 왼쪽 뺨을 1회 때려 폭행하고, 이를 만류하는 F의 왼쪽 정강이를 안전화를 신은 발로 걷어차는 등 폭행하여 치안유지 등에 관한 위 경찰관들의 정당한 직무집행을 방해함과 동시에 피해자 F에게 약 2주간의 치료를 요하는 ‘좌측 아래다리 부분의 타박상’을 가하고, 이어서 H 순찰차 유리창에 머리를 수회 들이 받아 수리비 330,275원 상당이 들도록 전면유리부분을 파손하여 공용물건을 손괴하였다.
